Abstract (english):
"Since considerable time will be required for the drafting and nationwide discussion of a new Constitution of Nepal" the author proposes an interim constitution "as a basis and framework for the provisional government of the Kingdom of Nepal". "That Nepal shall be henceforth a constitutional monarchy based on democracy" is one of his six "preliminary ideas for the elaboration" of such an interim constitution which he contributes to the discussion in Nepal. Abstract (english):
The author discusses some examples, not systematically, not covering the broad field of possible conflicts and issues in preparing a new constitution in Nepal which just has shaken off the hated Paneyhayat system and its absolute monarchy. Making clear that issues like fundamental rights, parliament, government and the specific features in Nepal tradition and society are not that easy a task neither for the legal experts nor for the politicians in drafting a new constitution , the author finally claims that the constitution must be adopted in a democratic process. As for the dilemma of the politicians to pass a new constitution within three months he proposes an Interim Constitution as a solution. (DIPF/ssch)
