Abstract (english): The educational systems in the European member states are very different due to the different legal cultures and national policies in education. From a comparative point of view this paper describes how the national legal systems in Austria, France, Germany, Greece, the Netherlands and the United Kingdom deal with the case on refusal or access to education for a pupil with insufficient knowledge of the majority language. The aim is to get to know whether there is a common understanding of fundamental rights in education. These were the questions raised in the workshop on 13/14 October 2008 in Berlin, which was organised by the German Institute for International Education Research (DIPF) and the European Association for Educational Law and Policy (ELA).
