Abstract: Im März 2001 veranstalteten das DIPF und das Max-Planck-Institut für Bildungsforschung in Berlin eine Konferenz zum Thema "Comparative Education Law: A New Approach". Eine als Doppelheft erschienene Sonderausgabe der britischen Zeitschrift "Education and the Law" enthält eine Auswahl der bei dieser Tagung gehaltenen Vorträge. Der Beitrag von Hermann Avenarius untersucht Fragen der Werterziehung in deutschen Schulen. Der Verfasser zeigt die Grenzen schulischer Wertorientierung auf, die sich aus dem verfassungsrechtlichen Gebot staatlicher Neutralität erge- ben, und beschreibt die Auswirkungen tiefgreifender Säkularisierung und des damit einhergehenden zunehmenden Relativismus auf die schulische Werterziehung. Avenarius erläutert das Verhältnis von Religion und Schule im Spiegel der Rechtsprechung: das Kreuz in der Schule, den Religionsunterricht als ordentliches Lehrfach und die Rolle des Ethikunterrichts, das Unterrichtsfach "Lebensgestaltung - Ethik - Reli- gionskunde" anstelle des Religionsunterrichts in den Schulen des Landes Brandenburg. Ausführlich geht er auf den Islam als eine neue Herausforderung für eine weitgehend säkularisierte Schule ein und verweist hierbei auf die Schwierigkeiten bei der Einführung eines islamischen Religionsunterrichts, auf den Streit um das "Kopftuch in der Schule" und auf den Konflikt um die Teilnahmepflicht einer Schülerin islamischen Glaubens am koedukativen Sportunterricht.
Abstract (english): In March 2001 the DIPF and the Max Planck Institute for Human Development held a conference on "Comparative Education Law: A New Approach" in Berlin. A selection of papers given at this conference are contained in a special double issue of the British Journal "Education and the Law". In his contribution Avenarius analyses problems of value orientation in German schools. He shows the limits of value education in public schools based on the constitutional principle of religious neutrality of the state and underlines the difficulties caused by the inevitable process of increasing secularisation and relativism in society. Avenarius describes the precarious relationship between religion and school as mirrored in the jurisdiction of the Federal Constitutional Court and of higher administrative courts: the cross in the school, religious instruction as part of the regular school curriculum and ethics as obligatory for pupils exempted from religious instruction, the new subject called "Lebensgestaltung - Ethik - Religionskunde" instead of religious instruction in the schools of the Land Brandenburg. The author examines in detail the Islam as a new challenge for a secularised school by referring to difficulties in introducing Islamic religious instruction, to the dispute about "the scarf in the school" and the conflict about a Muslim girl refusing to attend mixed sports lessons on the grounds of her Islamic creed.
