Abstract: Der Aufsatz macht deutlich, daß die öffentliche Schule mit zunehmender Eigenständigkeit die Chance gewinnt, ein eigenes Profil zu entfalten und pädagogisch erfolgreicher als bislang zu wirken. Das ändert jedoch nichts daran, daß sie dem Prinzip der Staatlichkeit unterworfen ist: Sie ist eingebunden in den Rechtsstaat, in die sozialstaatliche Ordnung, in die Demokratie; sie ist mit Rücksicht auf den Grundsatz staatlicher Neutralität vor dem Zugriff von In teressengruppen und weltanschaulichen Partikularismen zu schützen. Hüter dieser Staatlichkeit in der freiheitlichen demokratischen Ordnung unseres Gemeinwesens ist und bleibt zuvörderst die staatliche Schulaufsicht.
Abstract (english): The article points out that schools as a result of increasing autonomy have a better chance to develop their own profile and to act more successfully as educational institutions. This may, however, not affect the principle of stat e responsibility of the school as a public institution. The school therefore underlies constitutional principles as the rule of law, the social state, the democratic order. Because of the principle of neutrality of the state schoo ls have to be protected against interference of interest groups and ideologies. Custodian of the statal character of the school in the free democratic basic order of the constitution is and remains the school inspectorate of the state.
